Nowadays, every business has an online presence. But are you aware of the disclosure requirements as prescribed by MCA in this regard?
Even the private companies having their website are required to adhere to certain provisions and compliances about website disclosures in accordance with the Companies Act, 2013 that have been summarized in the below article.
|1.||LETTERHEAD||Name, address of its registered office and the Corporate Identity Number (CIN) along with Telephone Number, fax number, if any, e-mail and website addresses, if any, shall be mentioned on letterheads and all official publications.|
|2.||CORPORATE SOCIAL RESPONSIBILITY||CSR Policy of the Company, its Composition and the Projects approved by the Board.|
|3.||NOTICE OF GENERAL MEETING||The notice of the general meeting of the company shall be simultaneously placed on the website of the Company.|
|4.||RESIGNATION OF DIRECTOR||The Company shall within (30) Thirty Days from the date of receipt of notice of resignation from a director post the information on its website.|
|5.||ANNUAL RETURN||Copy of Annual Return, the web-link of such annual return shall be disclosed in the Board’s report.|
|6.||AUDITED ACCOUNT OF SUBSIDIARY||Every company having a subsidiary or subsidiaries shall place separate audited accounts in respect of each of its Subsidiary on its website.|
